These Terms and Conditions ("Terms") govern your use of the RapidVaidya mobile application, website, and healthcare services provided by RapidVaidya Health Pvt. Ltd. ("RapidVaidya," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

RapidVaidya is a technology platform that connects patients with verified healthcare professionals for home-based care services including nursing care, doctor visits, physiotherapy, pharmacy delivery, diagnostic lab tests, and elder care. We act as an intermediary platform facilitating the connection between patients and independent healthcare providers.

2. Eligibility

• You must be at least 18 years old to create an account
• Minors may receive services with a parent or guardian's consent and supervision
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• Services are currently available only in select cities in India

3. User Accounts & Responsibilities

• You are responsible for all activities under your account
• You must provide accurate health information for proper care delivery
• You must not share your account credentials with others
• You must notify us immediately of any unauthorized account access
• You must not use the platform for any illegal or unauthorized purpose
• You must treat healthcare professionals with respect and dignity
• You must ensure a safe and accessible environment for home visits

4. Booking & Cancellation

Booking

• Bookings are confirmed upon payment or payment commitment
• We will make best efforts to match you with an appropriate healthcare professional
• Service times are approximate; we will notify you of any significant delays
• You may need to provide additional information for specialized services

Cancellation

• Free cancellation up to 2 hours before the scheduled appointment
• Cancellations within 2 hours incur a fee of 25% of the service cost
• No-shows without cancellation are charged the full service amount
• RapidVaidya may cancel if no suitable professional is available (full refund provided)
• Emergency cancellations due to medical situations are evaluated case-by-case

Rescheduling

• Free rescheduling up to 2 hours before the appointment
• Rescheduling is subject to professional availability
• Repeated rescheduling (3+ times for one booking) may incur a nominal fee

5. Payment Terms

• All prices are listed in Indian Rupees (INR) and include applicable taxes
• Payment is required at the time of booking or upon service completion (as specified)
• We accept UPI, credit/debit cards, net banking, and select digital wallets
• Refunds for eligible cancellations are processed within 5-7 business days
• For care packages, payment schedules are outlined at the time of purchase
• Disputed charges must be reported within 30 days of the transaction

6. Healthcare Provider Disclaimer

While RapidVaidya verifies the credentials and qualifications of all healthcare professionals on our platform:

• Healthcare professionals are independent practitioners, not RapidVaidya employees
• RapidVaidya does not provide medical advice, diagnosis, or treatment directly
• Medical decisions and treatment plans are the responsibility of the healthcare professional and patient
• In case of medical emergencies, please call 112 or visit the nearest hospital immediately
• RapidVaidya services are not a substitute for emergency medical care

7. Limitation of Liability

To the maximum extent permitted by law:

• RapidVaidya's total liability shall not exceed the amount paid for the specific service in question
• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for actions or omissions of independent healthcare professionals beyond our verification obligations
• We are not liable for service interruptions due to force majeure events
• We maintain professional liability insurance for additional protection

8. Intellectual Property

All content on the RapidVaidya platform - including the app, website, logos, text, graphics, and software - is owned by or licensed to RapidVaidya and protected by Indian intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of RapidVaidya services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

10. Dispute Resolution

In the event of a dispute:

1. Contact Support: Reach out to our customer support team at care@rapidvaidya.com
2. Mediation: If unresolved within 30 days, either party may initiate mediation through an agreed-upon mediator
3. Arbitration: If mediation fails, disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore
4. Court: Either party retains the right to seek injunctive relief in courts of competent jurisdiction

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of our services after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the changes, you must discontinue use of our services.
